Terms of Service

These Terms of Service ("Terms") govern access to and use of the website, applications, and services operated by O1D Match LLC ("O1DMatch," "we," "us," or "our"), including www.o1dmatch.com and its subdomains (collectively, the "Service"). By accessing or using the Service, you ("you" or "User") agree to be bound by these Terms. If you do not agree, do not use the Service.

1. What O1DMatch Is

O1DMatch operates an information and matching platform that helps international athletes, artists, researchers, and other individuals of extraordinary ability ("Talent") connect with U.S. employers, agents, and third-party petition-preparation resources in connection with O-1, EB-1A, P-1, and related U.S. immigration categories. O1DMatch may also sell templates, guides, and packaged administrative-support services related to that process.

O1DMatch is not a law firm, does not provide legal advice, and does not represent Users before U.S. Citizenship and Immigration Services or any other government agency. Where petition preparation, legal review, or representation is offered, it is provided by independently licensed attorneys or law firms, and any such engagement is governed by a separate agreement directly between you and that attorney or firm. Nothing in these Terms, and nothing on the Service, creates an attorney-client relationship with O1DMatch.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or purchase services. By using the Service, you represent that the information you provide is accurate and that you have the authority to enter into these Terms.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

4. Fees, Billing & Payments

Certain features of the Service require payment of one-time or recurring fees, as described at the time of purchase. Payments are processed by third-party payment processors; O1DMatch does not store full payment-card numbers. By providing payment information, you authorize O1DMatch and its payment processor to charge the applicable fees to your selected payment method, including recurring charges for subscription plans until cancelled.

Except where required by law or expressly stated in a specific product's terms at checkout, fees are non-refundable once the corresponding service, content, or access has been delivered. Subscription plans may be cancelled at any time, effective at the end of the then-current billing period; O1DMatch does not provide partial-period refunds.

5. No Guarantee of Outcome

O1DMatch facilitates introductions and provides informational tools and resources. We do not guarantee that you will be matched with any particular employer, agent, or service provider, that any petition will be filed, or that any immigration petition or application will be approved. Immigration outcomes are determined solely by the relevant government agency based on the specific facts of each case, applicable law, and adjudicator discretion, none of which O1DMatch controls.

6. Acceptable Use

You agree not to: (a) provide false or misleading information; (b) use the Service for any unlawful purpose; (c) attempt to gain unauthorized access to the Service or any related systems; (d) scrape, reverse-engineer, or resell the Service without our written consent; or (e) impersonate any person or misrepresent your affiliation with any person or entity.

7. Intellectual Property

The Service, including its text, design, templates, and software, is owned by O1DMatch or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or internal business purposes. Templates and materials purchased through the Service are licensed for your own use and may not be resold or redistributed.

8. Third-Party Services and Links

The Service may link to or integrate with third-party websites, employers, agents, payment processors, or service providers that we do not control. O1DMatch is not responsible for the content, accuracy, or practices of any third party, and your dealings with any third party (including any employer, agent, or attorney you are introduced to) are solely between you and that party.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. O1DMATCH DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, O1DMATCH AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. O1DMATCH'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO O1DMATCH IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless O1DMatch and its owners, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the Service, other Users, or third parties. You may stop using the Service and, if applicable, cancel your subscription at any time.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Florida, and you consent to personal jurisdiction there.

14. Changes to These Terms

We may update these Terms from time to time. The "Effective" date above reflects the most recent revision. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
